Terms of Use
Effective September 28, 2026. Privacy Policy · Risk disclosure
Please read Section 20 carefully. It requires most disputes to be resolved by individual binding arbitration and waives class actions and jury trials, unless you opt out as it describes.
1. Agreement and operator
These Terms of Use ("Terms") govern your access to and use of the kontract.fun website, application and related interfaces and services (together, the "Site"), operated by Kontract Labs LLC ("Kontract", "we", "us" or "our"). Our Privacy Policy and Risk disclosure form part of these Terms. By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site. If you use the Site for an organisation, you represent that you may bind it.
Kontract has at most one official token. Once it exists, its single contract address is published on kontract.fun/token and on our official X account (@kontractdotfun), and nowhere else. Holding it gives your account the discounts and free custom addresses on the Site described on that page, which we may change or end. It gives no right to any fee, revenue, profit, buyback, distribution or other asset of Kontract, and nothing on the Site is a promise about its price or value. Anything else presented as a Kontract, KNTR, KNTRCT or Kontrakt token is not ours.
2. What the Site is
The Site is a software tool for creating digital tokens on third-party launch platforms at a contract or mint address you choose. It currently supports pump.fun, StonkFun and bonk.fun on Solana, Pons on Robinhood Chain and Flap on BNB Chain (each a "Platform"). We generate the address and prepare the transaction that creates your token on the Platform you pick; your own wallet authorises and pays for it. Your token is created by the Platform's contracts, and it trades on that Platform (and wherever it is later listed), under the Platform's own contracts, fees and rules, which we do not control. The Site does not trade tokens and has no pools of its own; its board lists tokens created through the Site and links to their Platform to trade.
Kontract is not a broker, dealer, exchange, custodian, investment adviser, money transmitter or fiduciary, and does not execute, clear or settle trades on your behalf. Kontract is independent of every Platform: naming one does not imply partnership, sponsorship or endorsement, and we cannot change, reverse or support anything done on it. Removing a token from the Site does not remove it from a blockchain or from its Platform.
3. Eligibility
- You must be at least 18 years old (or the age of majority where you live, if higher) and able to enter a binding contract.
- You may not use the Site if you are a Prohibited Person: a person or entity that is the subject of sanctions administered by the United States, the United Nations, the European Union or the United Kingdom (including anyone on the U.S. Treasury's Specially Designated Nationals list); that is located in, resident in or organised under the laws of a country or region subject to comprehensive sanctions, including Cuba, Iran, North Korea, Syria and the Crimea, Donetsk and Luhansk regions of Ukraine; or that is owned or controlled by such a person.
- You may not use the Site where doing so, or holding or trading a particular token, would be unlawful for you. You are responsible for knowing and following the laws that apply to you.
- You may not use a VPN or any other means to circumvent these restrictions. Technical access to the Site does not make you eligible.
4. Tokenized stocks and ETFs
Some Platforms let a token be paired with a token that gives economic exposure to a stock or exchange-traded fund, issued by a third party. These instruments do not give you shares in, or rights against, the company or fund they track, and they are subject to their issuers' documents and restrictions. They are not offered to U.S. persons, and other jurisdictions are restricted by their issuers. By choosing such a pairing, or buying or paying with such an instrument, you represent that you are not a U.S. person and that the transaction is lawful for you and permitted by the issuer. Kontract does not issue these instruments and is independent of their issuers and of the operators of the chains and Platforms the Site supports.
5. Meme coins
Tokens created through the Site are, for the most part, meme coins: made for entertainment, humour, community and internet culture. Their names, tickers, images and descriptions may be jokes, parody or exaggeration, and a reference to a person, company or event does not mean affiliation or endorsement. Meme coins may have no utility and may become worthless. Do not buy them expecting a profit from the work of Kontract or of a creator. A token created through the Site gives you no share in, or claim on, Kontract, its revenue or its assets. A custom address is a string of characters: it does not make a token safer, more valuable or endorsed by anyone. Language such as "moon" or "100x" is not a promise by anyone.
6. Accounts, wallets and security
You may sign in with a wallet you control or through our authentication provider, Privy (email or a social login), which may create an embedded wallet for you. The Site is self-custodial: Kontract never holds your private keys. Embedded wallets are provisioned and secured by Privy under its own terms. You are responsible for your devices, credentials, recovery methods and every transaction made from your wallet. Blockchain transactions are generally irreversible: we cannot cancel or reverse them, or restore access to a wallet. Refunds we owe under Section 8 are new payments from us, not reversals.
Transaction confirmations. So that using the Site does not mean approving a separate prompt for every step, an embedded wallet created for you is set up to sign the transactions you ask for without showing a confirmation dialog for each one. This applies only to actions you start — pressing Pay, Deploy or Launch, or confirming a step the Platform needs after a launch — and only while you are signed in and using the Site. Your instruction to perform the action is your authorisation to sign the transactions that carry it out. We do not hold your keys, we cannot sign for you when you are not using the Site, and we do not use your wallet for anything you have not asked for. The Site shows you what an action will cost, and what it will do, before you start it. You can export your embedded wallet's private key from Privy at any time.
One person, one account. An account may link several wallets, but you may not operate several accounts to obtain a benefit intended for one person. Usernames are unique and first-come; we grant them on a revocable basis and may reclaim one that impersonates a person, a company or Kontract, or that is abusive.
7. Launching tokens and content
You are the creator and are solely responsible for your token and everything you submit with it: its name, ticker, image, description, links, the options you choose on its Platform and anything you say about it. You represent that you have the rights to that material, that it is not false or misleading, and that creating and promoting the token is lawful where you do so. The Site shows each Platform's own options and fees as we read them from that Platform; the Platform's contracts decide what actually happens, and a Platform may change its options, fees or rules at any time. Token metadata is published to public storage (such as IPFS or Arweave) or to the Platform's own storage, and cannot be withdrawn by us once a token references it.
You keep the rights to what you submit and grant Kontract a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt and distribute it as needed to operate and promote the Site, including in share images and link previews. We may remove, hide or restrict any token, image, profile or other content on the Site at our discretion, including in response to complaints, suspected illegality or a breach of these Terms. That does not change anything on a blockchain or on a Platform. The appearance of a token on the Site is not verification, endorsement or a statement that it is safe.
8. Addresses, orders and refunds
Every token launches either at an address with the free standard ending the Site shows for its Platform, or at a custom pattern you choose. A custom address carries a fee shown in US dollars before you pay, and charged in the chain's native asset at the rate shown when you sign. How it is charged depends on the Platform:
- Solana, available now. The fee is charged in the same transaction that creates your token; if that transaction does not land, nothing is charged.
- Solana, made to order. Longer patterns are generated to order on rented hardware and paid in advance. The time shown is an estimate. If an order is not delivered within 24 hours, we refund the payment to the wallet that paid it. Once paid, an order cannot be cancelled, because the work starts at once; a delivered address stays reserved for your account, and a delivered address that you do not use is not refunded.
- Pons and Flap. Your address is generated first and you pay only once it exists, in a separate payment before your launch. You may cancel a paid order at any time before its launch transaction has been prepared, and we then refund the payment in full to the wallet that paid it. A payment that reaches us after you cancelled is refunded the same way, or, if you have not cancelled, completes your order.
Refunds are sent in the asset you paid in, to the wallet that paid, normally within a few days; the Site shows when one is due and when it has been sent. Network fees are not refunded. A launch address becomes yours when your launch lands; before then it is held for you only as the Site shows.
Free or discounted addresses (such as Founding 1,010, a referral address or a holder benefit) are limited, one per account across all Platforms, usable only as described, and may be changed or ended at any time.
9. Fees
Our fees. We charge for custom addresses as described in Section 8. On pump.fun, when your coin's creator rewards go to you (not to holders), Kontract receives 10% of the creator's share of its trading fees, through pump.fun's own fee-sharing setting; the Site shows this before you launch, and it is set on chain for the life of the coin. We may change our fees for future orders and launches; a change does not alter a launch already made.
Platform fees. Each Platform charges its own fees — for example a trading fee on every buy and sell, a creator fee, a launch fee, or a tax the creator sets — under its own contracts. The Site shows them as we understand them, but the Platform's contracts decide them, and a Platform may change them. They are not Kontract's fees, and we cannot refund them. Network fees are yours, including for transactions that fail.
10. Platform options for holders
Some Platforms let a creator send a token's creator fees or a tax to its holders, or split them between wallets. Where you choose such an option on the Site, it is set on the Platform, and the Platform calculates, administers and pays it under its own rules; some options cannot be changed after launch. Kontract does not administer, guarantee or pay any such distribution. It is not a dividend, an investment return or a share in anything.
11. Trading and information
Trading happens on the Platforms, not on the Site. You may lose everything you put into a token. Prices can move violently, liquidity can vanish, and transactions can be front-run, reordered, sandwiched or executed at a different price from the one quoted. Market capitalisations, rankings, clubs, charts and other information on the Site come from on-chain and third-party sources and may be delayed, incomplete or wrong. They are information, not advice, an offer or a promise that you can buy or sell any amount. See the Risk disclosure.
12. Prohibited conduct
You may not use the Site to: break any law or sanctions rule; commit or facilitate fraud, including rug pulls, misleading promotions or false claims of affiliation; manipulate markets or rankings, including wash trading, circular or coordinated trading, spoofing, or trading to inflate rankings, fees or rewards; impersonate anyone; infringe anyone's rights; post content that is unlawful, hateful, harassing, sexual content involving minors, or that promotes violence; launder money or finance terrorism; access the Site by automated means at a rate that burdens it, or scrape it without our permission; probe, test or disrupt the Site, its infrastructure or its contracts outside a disclosure arrangement with us; circumvent any access control, rate limit, promotion rule or eligibility requirement; or help anyone else do these things.
13. Intellectual property and feedback
The Site's software, design, text, graphics and the Kontract and kontract.fun names and marks belong to Kontract or its licensors. We grant you a limited, revocable, non-transferable licence to use the Site for its intended purpose. If you send us feedback, we may use it without restriction or payment. To report content that infringes your rights, contact us (Section 23) with the details required by the Digital Millennium Copyright Act or the equivalent law where you are; we will act on valid notices and may terminate repeat infringers.
14. Third-party services
The Site relies on services we do not control, including blockchains and their validators or sequencers, trading venues and their contracts, wallet and authentication providers, data and price feeds, storage networks and hosting providers. Their availability, security and terms are their own. We are not responsible for them, for linked third-party websites, or for losses they cause.
15. No advice; taxes
Nothing on the Site is investment, financial, legal or tax advice, and Kontract owes you no fiduciary duty. You are solely responsible for your decisions and for determining, reporting and paying any taxes that apply to your activity.
16. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND UNINTERRUPTED OR SECURE OPERATION. We do not warrant that a launch will land, that an order will be delivered in the time estimated, that any contract, chain, venue, wallet or provider will work as intended, or that any information is correct. Smart contracts, including ours, may contain defects and are generally immutable once deployed. Audits and testing do not guarantee security.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KONTRACT AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DIGITAL ASSETS, LOST DATA OR BUSINESS INTERRUPTION, ARISING FROM THE SITE OR THESE TERMS, EVEN IF ADVISED OF THEIR POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) US$100 AND (B) THE FEES YOU PAID DIRECTLY TO KONTRACT IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability for fraud, wilful misconduct or anything else that cannot lawfully be limited.
18. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless Kontract and its members, managers, employees and contractors from third-party claims, losses and reasonable costs (including legal fees) arising from your use of the Site, tokens you create or promote, content you submit, or your breach of these Terms or of any law.
19. Changes, suspension and termination
We may change, suspend or discontinue any part of the Site at any time. We may suspend or terminate your access, reclaim a username, or withhold a promotional benefit or referral reward if we believe you have breached these Terms, if the law requires it, or to protect the Site or its users. This does not affect assets or contracts on a blockchain. We may update these Terms; the effective date above will change, and material changes will be announced on the Site. Continuing to use the Site after a change means you accept it. Changes to Section 20 do not apply to a dispute we already knew about. Sections that by their nature should survive termination will survive.
20. Governing law and dispute resolution
- Governing law. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules, and, for this Section, by the Federal Arbitration Act.
- Informal resolution first. Before starting any proceeding, you and we will try to resolve a dispute informally for 60 days after one of us notifies the other in writing (Section 23).
- Binding arbitration. Any dispute, claim or controversy arising out of or relating to the Site or these Terms that is not resolved informally will be finally resolved by binding arbitration before a single arbitrator administered by the American Arbitration Association under its applicable rules. Arbitration may be conducted by video conference. Either party may instead bring an individual claim in small-claims court, and either party may seek an injunction in court to protect intellectual property.
- Class action and jury waiver. Claims may be brought only in an individual capacity, not as a plaintiff or class member in any class, consolidated or representative proceeding. You and we each waive the right to a jury trial.
- Opt-out. You may opt out of arbitration by writing to us (Section 23) within 30 days of first accepting these Terms, with your name, username or wallet address and a clear statement that you opt out.
- Time limit. Any claim must be brought within one year after it arose, or it is permanently barred, to the extent the law allows.
21. General
These Terms, with the Privacy Policy and Risk disclosure, are the entire agreement between you and Kontract about the Site. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for failures caused by events beyond our reasonable control, including chain halts, network attacks, outages of third-party services, and changes in law.
22. Referral program
- What you earn. When someone you refer buys a custom address on kontract.fun, you earn 25% of the fee they paid for it, valued in US dollars at the time of their payment. You earn nothing on a free address, and nothing on a payment that is refunded or due to be refunded. There is one level only: you earn nothing from people your referrals refer. The amount of each reward is fixed when it is recorded.
- Who counts as referred. A person is referred by you when the first referral link they open is yours and, within 30 days of opening it, they sign in to a kontract.fun account that has not yet launched a token or paid for an address. A referral is permanent and cannot be moved to someone else, and only payments made after it began count. Existing or former users cannot be referred.
- What the person you refer gets. An account referred under this program gets one custom address of up to four characters free, on any Platform the Site supports, for one launch within 14 days of being referred. It is used only when that launch lands. It is one free address per account: it cannot be combined with Founding 1,010 or any other free-address offer, and we may end it at any time.
- Your link is your username. Your referral link is kontract.fun/r/ followed by your username. If you change your username, your link changes with it; the people you already referred stay yours, and so do the rewards from their payments. Your old username can then be taken by someone else, and from that moment a link with your old username refers people to them, not to you. A link opened while the username was yours still counts for you.
- When it is earned. A reward is pending for 7 days after we record the payment. It is then earned unless the payment was refunded, or the reward is held for review.
- Not allowed. Referring yourself, or any account you own, control or operate with others; creating accounts to refer; buying addresses to generate rewards; automated sign-ups; spam or unsolicited messages; misleading claims, including promises of profit or investment advice; presenting yourself as acting for Kontract; and bidding on or imitating the kontract.fun name in advertising. When you share a link that earns you rewards, say so.
- Review, withholding and clawback. We use account, wallet, device and network signals to keep the program fair and to detect the conduct above. We may, at our sole discretion, hold a reward for review, void it, reverse it, or claw back a reward already paid (by deducting it from future rewards or asking for it back). A held reward shows as "Under review", and you can ask us to look at it again through support.
- Payment. Earned rewards are paid in USDC on request to a wallet linked to your account, once they reach $10. We aim to pay within a few days of a request. You are responsible for any taxes on what you receive, and we may ask for information needed to pay you lawfully.
- Where it is offered. The program is not available where it would be unlawful, to Prohibited Persons, or to residents of the United Kingdom. By requesting a payment you represent that you are eligible, and we may withhold payment from anyone who is not.
- Changes. We may change, suspend or end the program, or change the reward rate, at any time, including without notice. A change does not reduce the amount of a reward already recorded; it may still be held, voided or reversed under these Terms.
- No guarantee. Rewards depend on other people's purchases. We do not promise any amount, and a reward is not an investment or a share in Kontract.
